Why do you need to register a trademark?
A registered trademark is your legal shield. Almost any distinctive element of your brand can qualify — including words, names, slogans, logos, colours, shapes, sounds, or any combination of these. If it sets your business apart, it can likely be protected.

  • Decide on the distinctive element you wish to protect — a word, name, logo, colour, or any combination of these.
  • Conduct a thorough clearance search to confirm your proposed mark is not already in use or registered by another party.
  • Compare your mark against existing registrations in the relevant Intellectual Property databases across your target jurisdictions to verify it is eligible for registration.
  • Full details of your proposed trademark — whether a word, logo, colour, or a combination of these.
  • The trademark class or classes under which you wish to register.
  • Once your application is submitted to the relevant Intellectual Property Office, you can expect an examination report within the following timeframes: approximately 2 weeks for the UK, 4 weeks for the EU, and 4–6 weeks for Hong Kong. The report will confirm whether your trademark is approved for registration or whether amendments are required. If changes are needed, you will typically be given 2 to 3 months to address and rectify the issues before your application can proceed.

If your application passes examination without issue, it will be published in the official Trademarks Journal — for 2 months in the UK, and 3 months in both the EU and Hong Kong. During this period, any third party may file an opposition. Should your trademark be opposed, you have three options:

  • Withdraw your application.
  • Negotiate directly with the opposing party to reach a resolution.
  • Formally defend your application — this route requires engaging a trademark lawyer and will involve additional time and cost.

Once successfully registered, your trademark is valid for 10 years and must be renewed upon expiry. As a registered owner, you may oppose any future applications that are identical or confusingly similar to your mark. You may also sell, license, or use your trademark as collateral — particularly where it can be demonstrated to hold significant value as an intangible asset. Any changes to the registration, such as the owner’s name, appointed representative, or correspondence address, should be promptly reported to the relevant Intellectual Property Office.
